Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the WebRooted website and services operated by WebRooted Technologies Pvt. Ltd.
1. Acceptance of Terms
By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services.
2. Services Description
WebRooted provides website development, mobile application development, digital marketing, and DevOps services to clients. The specific deliverables, timelines, and payment terms for each project will be outlined in a separate agreement or statement of work.
3. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete information required for the project
- Reviewing and approving deliverables in a timely manner
- Providing feedback and content as required
- Making payments according to the agreed schedule
- Ensuring they have the necessary rights to any content provided to WebRooted
4. Intellectual Property Rights
Upon full payment, clients will receive ownership rights to the final deliverables created specifically for their project. WebRooted retains ownership of all pre-existing materials, tools, and frameworks used in the development process.
WebRooted reserves the right to display and link to completed client projects as part of our portfolio unless explicitly agreed otherwise.
5. Payment Terms
Payment schedules and amounts will be specified in the project agreement. Unless otherwise stated:
- A non-refundable deposit of 50% is required to commence work
- Remaining balance is due upon project completion and before final deliverables are released
- Additional services requested beyond the original scope will be billed separately
- Late payments may incur additional fees
6. Project Timelines
Project timelines are estimates and may be affected by client responsiveness, change requests, and other factors outside our control. WebRooted will make reasonable efforts to meet agreed deadlines but cannot guarantee specific completion dates.
7. Limitation of Liability
WebRooted shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our services. Our total liability for any claims under these Terms shall not exceed the amount paid by the client for the specific project.
8. Termination
Either party may terminate the service agreement with written notice if:
- The other party breaches a material term of the agreement
- By mutual agreement
- The client fails to provide necessary information or feedback for 30 consecutive days
Upon termination, the client shall pay for all services rendered up to the termination date.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
10. Changes to Terms
WebRooted reserves the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of these Terms.
